The CA   B Forum announced adjusted rules of extended verification  EV  in relation to recognized notaries

CA / B Forum, the regulator of the SSL industry, has updated rules concerning the involvement of trusted notaries in the EV extended validation process.

In accordance with the previously adopted rules, the certifying authority before relying on the legal opinion received should be ascertained that it meets the following requirement: 

"A legal opinion must be provided by an independent practicing lawyer who is a notary participating in the International Union of Latin Notaries and has a license to practice in the country of the applicant's jurisdiction or in any jurisdiction in which the applicant has an office or physical object (and such jurisdiction recognizes the role of the Latin Notaries)"

According to EV extended validation rules, "Latin notary" stands for a person with a legal education whose duties include authentication of the signatures execution on documents, as well as responsibility for the correctness and contents of the document (in accordance with the applicable laws).

In the previously used regulation, the CA / B Forum could not accept mails from Latin notaries (individuals) who were not members of the IULN (International Union of Latin Notaries).

The proposal to remove the requirement that the Latin notary should be a member of the IULN was placed by Jeremy Rowley of DigiCert, and was voted on. The proposal was accepted by the absolute majority of participants of the CA / B Forum.

In the recently accepted updated version of EV rules, following individuals may act as independent practicing lawyers:

  • (i) Lawyers (legal advisers, barristers, solicitors and equivalent positions) licensed to conduct legal activities in the jurisdiction of the applicant or in any other jurisdiction in which the applicant has an office or physical institution, or 
  • (ii) Latin notaries who are currently authorized or licensed to practice in the country of the applicant's jurisdiction or in any other jurisdiction in which the applicant has an office or physical institution (and this jurisdiction recognizes the role of the Latin notary).

Thanks to a recently adopted proposal the list of trusted lawyers whose conclusion can be used by certifying authorities when performing an extended validation (EV) has been significantly expanded.
